1. 收集政策及目的
我們（帆船飲食集團有限公司）承諾會完全符合香港法例第486章《個人資料私隱）條例》的規定。為達到此目的，我們會確保員工遵守最嚴謹的安全及保密指標。懇請您細閲此聲明，以了解我們於處理您於「流動應用訂餐程式」向我們提供的個人資料時，所採用的政策及慣例。如您使用本網站，則表示已同意我們根據聲明收集、使用及披露您的個人資料。
務請注意，本聲明所載的條文或會於我們認為需要不時予以更新、修訂、更改及修改。您於作出修訂後繼續使用本網站，將被視為接納經修改的聲明。您有責任定期查閱聲明中所作出的任何修改。
聲明備有中文及英文版本，中、英文版本的聲明如有任何歧異或不一致之處，概以英文版本為準。

2. 收集個人資料的用途
在使用本程式的過程中，您或會披露或被要求提供個人資料。為令您可受惠於及享用我們提供的各項服務、資訊及推廣資料，我們需要向您收集若干個人詳細資料。儘管您並無義務提供本程式所要求的數據及資料，惟倘您未能提供所需資料，我們將不能向您提供服務、資訊及推廣資料。
我們於本程式收集的資料及數據會用於（包括但不限於）以下用途：
2.1建立和管理您的帳戶；核實您的身份；
2.2就與您使用本程式及／或我們提供的服務有關的政策變動、行政通告及通訊，與您聯絡；
2.3處理訂單和服務有關的安排；回應您的要求和詢問，並提供客戶支援；
2.4 管理及並向您發送有關產品及服務資訊、推廣及銷售活動、獎勵計畫、健康通訊等訊息；2.4協助我們的未來營銷發展及／或與第三方舉行聯合推廣活動；取得有關網站使用者統計數據，以分析網站的使用狀況，從而協助其進一步發展；及檢討我們宣傳及營銷活動的效果。

3. 收集本網站使用者的個人數據
當您進入本程式時，我們會紀錄您的域名服務器地址及/或電郵地址，跟蹤您所瀏覽的頁面，並於「cookies」內儲存有關資料。這個程序會在您不知悉的情況下進行。一般而言，我們會利用「cookies」估算受眾規模、估計本程式內各部分的受歡迎程度，跟蹤使用者的走向及參加推廣活動的人次，以及計量使用者的人流模式。除第4段所列明的情況外，以「cookies」方式收集的資料及數據將不予披露。

4. 轉交及披露個人資料
我們不會在未經您同意下向第三方出售、出租及買賣從您取得的個人資料(無論是全部或部分)。
我們同意採取所有可行步驟，將您個人資料保密及/或不予披露，惟在以下情況，上述資料及數據或會予以披露及/或轉交：
4.1 向經我們正式授權可使用上述資料及/或數據的任何第三方供應商或服務供應商提供資料，有關人士將協助我們的服務；
4.2 向經我們正式授權可使用上述資料及/或數據的任何代理人、顧問、附屬公司或聯營公司提供資料；
4.3 當我們需要保障及維護我們的權益及財產時；
4.4 當我們認為我們必須提供資料以遵守適用法律法規時；及
4.5 當我們認為必須提供資料以維持及改進我們服務時。

如您使用本程式，則會被視為已同意、准許及授權我們在上述情況下，披露及轉交您的個人資料。

5. 連接至其他網頁
為向您提供更多資訊，本程式有可能會提供其他網頁的連結或若干社交媒體網站。當您瀏覽該等其他網頁及使用當中所提供的服務時，您的個人資料或會被收集。倘您決定點擊本程式的廣告及超連結，使您連接至另一程式，則對您視為私人及保密的個人資料的保障或會於該等其他網頁上顯露。

6. 安全
我們重視以保障從您收集得來的個人資料。我們將致力確保您的個人資料受到保護，不被未經授權地存取。我們已實施適當的電子及管理措施以維護、保護和保障您的個人資料。
您所提供的一切個人資料將以SSL技術加密及轉移至我們的伺服器或經我們正式授權的第三方的其他伺服器，並將配合合適的電子密碼工具，以電子方式儲存。該等個人資料僅可由我們或經我們授權的第三方的授權人員存取，而該等人員於存取相關個人資料時會被指示細閱聲明當中的條款。
請您放心，您的個人資料僅會用於需要達成上文第2段所述的收集目的，除非您要求我們停止將資料使用於該等用途。如您有此要求，或會使我們未能繼續向您提供服務、資訊及/或推廣資料，使您可於日後受惠。

7. 營銷資料
我們或會根據您向我們提供的個人資料，不時向您傳送推廣活動資料，以及有關我們的產品、服務及類似事項的資料。倘您不希望收到我們的推廣活動資料及資訊，您可電郵至cs.smenu@sailingboat.com.hk致函我們的顧客服務主任表示不參與。

8. 存取數據
如您想查詢及/或索取您於我們的記錄中儲存的個人資料。您可電郵至cs.smenu@sailingboat.com.hk致函我們的顧客服務主任，以行使您的權利。我們會盡量於收到您上述要求後40天內回應，不過可能需要向您收取合理的費用。收到上述請求後，我們或會要求您提供個人詳細資料以核實您的身份。

1.1 In collecting, using, storing, retaining, disclosing, transferring, providing, allowing access to, protecting and accessing Data, we shall comply with the requirements of the onal Data (Privacy) Ordinance (Chapter of the Laws of Hong Kong SAR).

2 Collection of Data and Information 2.1 When you use the“S.MENU點餐易”App and/or the Sites and/or participate the membership program managed and operated by Sailing Boat’s Client"), we may collect Data ding but not limited to your name, address (including working place, residential address and/or delivery address), contact details (including telephone, mobile phone and/or fax numbers), birthday (date and month), gender, electronic payment information, octopus card details, credit card details and billing information (if you place an order with us for our goods or services), email address, IP address, operating system type, browser type, domain name, access time and other information relating to other persons relevant to the information or services you have requested, from you which will be used as follows: (a) for verification of identity and record for the purposes of recruitment, providing goods and services and/or customer services; (b) to fulfill your order for goods or services and processing of such order, payment and any outstanding amounts; (c) to store contact details in our internal database; (d) to generate surveys on user traffic on the “S.MENU點餐易”App and/or Sites; (e) to respond to and process any query from you or fulfill requests submitted by you; (f) for evaluation and further enhancement of our goods and services; (g) for conducting market surveys, research or analysis relating to our customers, goods, services, activities, promotions or events; or (h) to administer, operate, participate in, interact, partner or collaborate with customer loyalty programs, including but not limited to customer profiles and customer benefit.
2.2 You acknowledge and agree that the provision of your Data to us is voluntary.
2.3 You may request to access, update or correct your preference with regard to the information and materials you received from us or our use of your Data by sending email Customer Service Department at cs.smenu@sailingboat.com.hk .

3 Use of Data for Direct Marketing
3.1 We intend to use your Data for purpose of direct marketing by sending you the direct marketing communications, such as mail, telephone and SMS containing news, messages and promotions on food, beverage, catering products and services. We shall not use your Data for such purpose unless we have obtained your consent.
3.2 We are not allowed to provide your Data to any third party for direct marketing purposes without your written consent.
3.3 If you do not wish to receive any direct marketing communications from us, irrespective of whether you have registered to become customer or you have given your consent to us, you may update your preference in “S.MENU點餐易” App or send your request together with your name (registered if applicable), contact telephone number registered one, if applicable) and email address (registered one, if applicable) to Customer Service Department via email at cs@sailingboat.com.hk indicating your request to cease using your Data for direct marketing purpose by us. Upon receipt of your request, we shall cease to use your Data for direct marketing purpose within 7 working days from the date of receipt of your complete request.

4 Security
4.1 We will use adequate security technologies and procedures to protect the Data from unauthorized access, use or disclosure. However, due to the nature of the Internet and technology, it is possible that others may intercept the information you are sending to or transmitting through the “S.MENU點餐易” App and/or Sites. We do not warrant that the “S.MENU點餐易” App and/or Sites are impenetrable or invulnerable to hackers.

5 Disclosure, Retention and Storage of Data
5.1 You acknowledge, agree and authorize us to retain and store the Data in one or more of our databases within or outside Hong Kong.
5.2 Except with your prior consent or as permitted by law, we will not transfer, disclose, provide or allow access of your Data to any third party except as stated below:
(a) Sailing Boat Catering Group Limited being our parent and its subsidiary companies respectively;
(b) Our employees;
(c) Credit companies for payment transactions;
Any person or organization to whom we are required to make disclosure to (i) in accordance with the requirements of applicable laws, court orders, administrative policies or regulations, guidelines or directives, (ii) orders given or issued by any regulatory, governmental, tax, law enforcement, other authorities, self-regulatory or industry bodies in or outside Hong Kong, (iii) in connection with any legal proceedings or (iv) for establishing exercising or defending legal rights in Hong Kong;
(d) Any person, organization or entity for the purpose of conducting due diligence in connection with our business, merger, acquisition or transfer of business;
(e) Any person, organization, entity or authority to facilitate identification of an individual involved in a life threatening or emergency situation; or
(f) Any agent, contractor or third party service provider who provides operation, research, sale, data analysis and processing, computer technology, telecommunication, telemarketing, payment or other services in connection with our business operation, provision of our goods and/or services and Customer management and operation. You acknowledge, agree and authorize us that we may transfer, disclose, provide or allow access your Data to execute, implement or comply with any term of our Terms and Conditions or the Privacy Policy.
5.3 Sailing Boat shall not keep your Data longer than is necessary for fulfilment of the purposes specified above for which they are, or are to be used.
5.4 Data provided by you is retained if the purpose for which the Data was collected still exists, it is so required by law, statute or regulation, or it is in the public interest.

6 Data Access and Correction
6.1 You are entitled to check whether we hold Data about you and to access any such Data if applicable, to require us to correct and accurate Data or update it. If you wish to access, correct or update your Data, please email to Customer Service Department at cs.smenu@sailingboat.com.hk (for change of your name, contact no. and/or password under the Customer only). We will endeavor to respond within 7 working days of your complete request.

6.2 If you wish to withdraw from Client and/or request for removal or deletion of your Data, you may send your instruction/request together with your name (registered if applicable), contact telephone number registered one, if applicable) and email address (registered one, if applicable) via email to Customer Service Department at cs.smenu@sailingboat.com.hk. Upon request of your instruction/request, we shall remove or delete your Data within 7 working days from the date of receipt of complete instruction/request.

7 Cookies
7.1 We may use cookies on the “S.MENU點餐易”App and/or Sites. Cookies are small bits of information that are automatically generated by a website or mobile application person's web browser in his/her computer or device that can be retrieved by that website or mobile application. The information collected by cookies is anonymous aggregated research data, and contain no name or address information or any information that will enable anyone to contact you via telephone, email or any other means. Most browsers are initially set up to accept cookies. Should you wish to disable those cookies you may do so by changing the settings on your browser. However, as cookies are necessary for some features of the “S.MENU點餐易”App and/or Sites to work, e.g. to maintain continuity during a session, if they are disabled, those features may not work properly and this may cause some of our webpages to display incorrectly or not at all.

8. Minors
We are not obliged to check or verify age and assume that you are the age 18 or above. If you are under the age of 18 or do not have the ability to enter into a contract, you should not provide any Data on the “S.MENU點餐易” App and/or Sites without prior consent from your parents/guardians. Parents/guardians are advised to monitor their children/minors when they are online.

9. General
9.1 In case of any conflict or inconsistency between the English and Chinese versions of the Privacy Policy, the English version shall prevail over the Chinese version (which is provided for information purposes only).
